That's exactly the kind of limitation the disability system is meant to account for, which is why it carries so much weight.

The problem you run into at your hearing

Here's where it gets difficult. When you get in front of a disability judge, they are not always going to give you the benefit of the doubt. They can decide that your subjective symptoms, the pain, the fatigue, the things only you can describe, aren't severe enough to keep you out of work that often. If the whole argument rests on how you say you feel, a judge has room to discount it.

What your medical records can prove that your words can't

What a judge can't do is ignore your medical records. If your file shows a real history of appointments and absences in excess of what a normal employer would allow, that's objective evidence sitting right there in the record. For clients with a large volume of records, what I commonly do after the hearing is send a letter to the judge that cites the file directly, listing the dates of every appointment, showing how often the person was out, often well past three days in a month. When the evidence is in the file that you have to treat that regularly for your conditions, the judge can't pretend it isn't there.
