If you’re helping someone over 50 with a Social Security Disability claim, there’s an advanced tactic that can be surprisingly effective, even when a claimant does not technically meet a listing.
Most people know about the Disability Listings, those strict medical criteria that, if met, automatically qualify someone for benefits. The catch is that listings are extremely hard to satisfy. But for claimants over 50, the rules shift. Instead of proving there are no jobs they can do in the national economy, the focus narrows to whether they can still perform light work, meaning jobs that require standing or walking most of the day and lifting up to 20 pounds.
This is where the listings become useful as context, even when they are not fully met. Take anemia as an example. Judges may not intuitively understand what low hemoglobin levels mean functionally. The anemia listing spells it out. While the listing itself requires multiple readings at extremely low levels, even readings that come close can demonstrate severity. When a claimant over 50 has hemoglobin levels far below normal and consistent fatigue documented by medical providers, that evidence can persuasively show they can no longer handle light work. You are not arguing the listing is met, you are showing the judge what a severe case looks like and why the claimant’s limitations matter.
