A lot of people feel nervous about testifying at their Social Security Disability hearing. I hear questions like, “What if I forget things?” or “What if I get emotional and start crying?” or “What if I don’t explain myself very well?” And the big fear underneath all of that is usually the same, will this hurt my case?
The short answer is usually no. In many situations, struggling during your testimony can actually help your case, not hurt it. One of the main things the judge is evaluating is credibility. If your medical records say you deal with anxiety, memory problems, or difficulty concentrating, then it would actually be inconsistent if you testified smoothly and confidently without any issues.
On the other hand, if you need questions repeated, have trouble remembering details, or get emotional during a stressful hearing, that lines up with what you’re claiming and can make your testimony more believable. And remember, your attorney is there to guide you and ask follow-up questions if something important needs to be clarified. You don’t have to be perfect, you just have to be honest about what you’re dealing with.
Action Items:
Be honest about your symptoms, even if it feels uncomfortable
Don’t panic if you get emotional or need a break, that’s okay
Trust your attorney to help fill in any gaps during your testimony
Focus on explaining your limitations as they really are, not how you wish they were
